Tribute to Almarhum Dr Husin Hamid Hassan
This fatherly great scholar has passed away. He was born in Egypt but grew up as a global citizen. His noted signature underlying the fatwas of so many Islamic financial products has been a common feature in Islamic finance.
I met with him for the first time while presenting my paper on Financing Intellectual Property (in Arabic) at Dallah Barakah seminar in Mekah in Ramadhan (around 1997). He said to me "Dr Mohammad, you are courageous enough to write on this". I later joined the AAOIFI being the youngest scholar in 2000. He was the prominent member in AAOIFI. I have learnt a lot from him during AAOIFI intensive series of meeting.
Then I worked with him officially through Dar al-Istithmar's Shariah Board in Oxford, UK (2005-2010).
I enjoyed reading all his articles & books .
He was so active in many things. Shariah advisory. Talks. Articles. Fatwas.
He also innovated many new things in Islamic finance.
Two things that I am intrigued to share about him.
He told me that he took two courses concurrently while doing his first degree. He did Shariah and Law. He got stuck because some of the exams were clashing.
"I sat for 40 minutes for my Shariah exam and I rode my motorcyle for 30 minutes to sit for my law paper for the last 40 minutes. With the grace of Allah, I passed with distintion". For me, he is the legend of intensity.
Another episode of life worth tellling happened in Mecca in 1998. After Zohor prayer, I stopped at one of the local restaurants alongside the crowded streets (i.e.sha'biyyah). While I was eating the beriyani, this great scholar came in & sat down at one of the tables together with many other ordinary people. He ate what others were having. He is a personality of humility.
Can we find the replacement of him? We may find someone of his credential but we might not find someone of his character & personality.
I always consider him as the father, mentor, colleague & inspirator.
May Allah bless his soul & forgive all his sins. May we be gathered again in the Paradise.

High-ranking officials who have been sanctioned by the US and those who have not yet made it on the list have each responded, one after another, in a “One Country, One System” tone of voice. Apart from "resolutely opposed" and "severely condemned," they have not addressed the reasons behind the US’ decision for the sanctions. They say it is an honor to be sanctioned for the cause of the nation. Some simply issued statements in simplified Chinese characters, clearly not targeted at the Hong Kong people. The most ludicrous is that Carrie Lam said she was planning to proactively cancel her US visa that expires in 2026 anyways. It turns out that she cannot enter the US border because she “voluntarily canceled” it herself. Her Ah-Q-style, self-consoling spirit does not die!
An honor or a disgrace, it really depends on who issued the sanction. To be sanctioned by North Korea, Cuba, Russia or China is not the same as being sanctioned by the US. As such, feelings of glory or humiliation should be the opposite too. Some international experts and finance experts analyzed that the strictest clause is to “prohibit all transactions by US persons or within (or transiting) the US that involve any property or interests in property of designated or otherwise blocked persons.” If genuinely implemented, it would mean that the bank accounts and credit cards of sanctioned individuals will be canceled, their Facebook accounts will be shut down, McDonald’s cannot sell them Happy Meals, they cannot buy iPhones from Apple and cannot enjoy original factory maintenance services, etc. It is said that even China-funded banks will be black-listed because China-funded banks also have branches in the US. It is still uncertain whether these will be the case because never before have sanctioned individuals come from an international finance center such as Hong Kong. Although it is undetermined, the concerned parties cannot but consider the implications and countermeasures if confirmed. It is embarrassing enough just not to be able to use a credit card.
In 1969, the Soviet Union wanted to carry out a “surgical strike” on China’s nuclear base. It tried to gauge the reaction of the US, but the US halted them to stop. Why did not the Soviet Union test the water with other nuclear-weapon states such as the UK and France? This is because the US military power is strong enough to contain reckless military actions by other countries.
In 1971, Henry Kissinger made a secret visit to China and the Sino-US relations achieved a major breakthrough. That year, the United Nations (UN) General Assembly passed a motion to admit the entry of China in the UN. How is it that China had struggled for more than two decades to join the UN but managed to win the resolution this round? This is because the US had changed its China policy.
In 2000, the US granted China permanent normal trade relations status. The following year, China entered the World Trade Organization (WTO) and has since found prospering opportunities to become the World’s Factory in the global market. Why had China not been able to enter the WTO for so many years? This is because the US did not grant China this permanent normal trade status until this time.
When China and the US commenced diplomatic relations in 1979, Deng Xiaoping visited the US and said to his accompanying associate on the plane: “Looking back over the past few decades, all countries that have good relations with the US have prospered.” China has indeed thrived. What Deng did not say was that the countries that have unfriendly relations with the US have pauperized, such as Cuba, China before 1976, and even the Soviet Union, which had only strategic weapons, and its people had to line up to buy bread.
The Cold War after the Second World War was led by the US, and other Western countries followed. The US has always been the trending global leader with its national power, system, technology, dollar hegemony, pop culture, and free spirit. It is not that the US does not make mistakes, but its system and the spirit of freedom make it capable of correcting its mistakes. The US began the wave of diplomatic relations between Western countries and China in the 1970s, and the trend of investing in China in the 21st century. Without the US, China would still be isolated and impoverished. The US is now making amends and starting an ultra-cold war with China, which seems to have also shown a trend-setting momentum.
So, are sanctions the new direction? At least the Five Eyes Alliance will follow subsequently. Stop deceiving yourself with “I have no assets in the US” and “I do not want to go to the US.”
Therefore, not only eleven individuals and their families suffered insomnia last Friday night, but also some followers and those who did things against their conscience. Returning officers responsible for disqualifying nominees, wicked police officers, 18 members of the Council of the University of Hong Kong, and those who claimed not patriotic enough to make it to the first sanction list and not able to enjoy the honor. I’m afraid they did not get a wink of sleep either or at least suffered anxiety because only an idiot cannot see the true powers and the direction of the world trends.
The humiliation brought about by being cut off from US companies, the immediate considerations of various inconveniences, the spread of sanction from the US to other civilized countries, the devastating impact on the will to govern subordinates and the entire ruling team, and many more. These will not just happen overnight but will come one after another and very soon. The responses of the sanctioned high-level officials are really just nightcrawlers whistling.

It is too late to “chicken out” now (Lee Yee)
Pro-establishment camp keeps spreading news about postponement of the Legislative Council (LegCo) elections. Following Tam Yiuchung, Tong Kawah said the government could put the elections on hold for 14 days as many times as necessary. Tanya Chan pointed out that the government seems to intend extending the current LegCo session in view of the absence of gazetted announcement of when it will end.
Communist China and Hong Kong originally planned to threaten Hong Kong people with the National Security Law, then browbeat candidates into signing a confirmation in support of the law that is to be used as evidence to disqualify (DQ) the opposition faction from the elections. By doing so, they are to get the elections in the bag. However, to everyone’s surprise, the National Security Law has stirred up worldwide backlash, putting China under siege. Meanwhile, Hong Kong have not overawed, as evidenced by their will to resist demonstrated in the primary elections of pro-democracy camp, in which a large number of young pro-resistance hopefuls were elected. So long as the Carrie Lam regime massively disqualifies candidates, it will certainly give rise to an even fiercer global backlash. Providing that the anti-China measures escalate, neither will China be able to stay authoritative in front of its compatriots by showing the white feather, nor will it be courageous enough to wage a head-to-head battle.
It seems that the DQ strategy has been relinquished. Swift and decisive enforcement of the National Security Law was seen merely on the first day of its implementation. Since then, it has rarely been cited for law enforcement. Even though Communist China and Hong Kong stubbornly refuses to admit a fault, they are inarguably aware of having been a bit “cheeky”. Ditching the DQ strategy, they may suffer a crushing defeat in the elections. What should they do now? To counterplot, the epidemic could be a convenient pretext for putting off the elections.
Nonetheless, while the plight in which China is under siege by the world has gotten in shape, it is too late to “chicken out” . On July 21, Pompeo met with Nathan Law, an activist from Hong Kong. Law said to him that disqualifying candidates from elections amounts to a severe challenge to the values of democracy, calling on the international community to respond to it with a tough stance. So, even if the elections are put off, the U.S.’s sanctions will not be delayed.

The U.S. State Department said: The consulate was directed to close in order to protect American intellectual property and Americans' private information. China has been engaging in espionage and infiltration for decades, and in recent years, it has gone deeper and more extensive.
U.S. senator Marco Rubio said the Consulate General of the PRC in Houston is not a diplomatic unit , but the central point of China’s enormous operation network of espionage and infiltration, which should have been closed. Holding a concurrent post of the Deputy Chairman of the U.S. Senate Intelligence Committee, Rubio has access to the classified information of the U.S. Congress.
Gordon G. Chang, a prominent American academic, said the U.S. should direct the Consulate General of the PRC in New York to close as well for it is the core operation center of the CCP in eastern America.
Trump said yesterday there is a possibility that other consulates of China are ordered to close as well.
China indicated that “necessary reactions would be made”. According to Reuters, China is considering closing the Consulate General of the U.S. in Wuhan for retaliation. Global Times Editor in Chief Hu Xijin said “80%” of the Reuters’ coverage is “wrong”, being of the opinion that Beijing would highly likely adopt a tit-for-tat strategy to close the Consulate General of the United States in Hong Kong, which is as equally important as the one in Beijing, or expel half of the personnel from Hong Kong.
China had better ditch the rhetoric and do it fast. Although “80%” of Reuters’ coverage may be “wrong”, I’m afraid what is wrong is China dare not even close the Consulate General of the U.S. in Wuhan. The response yesterday of the spokesperson of the Ministry of Foreign Affairs of the PRC to closure of the Consulate General of the PRC in Houston was also empty rhetoric. And its reaction to the UK offering BNO holders right of abode in the UK was: “China will consider denying BNO passports as valid travel documents.” It is not only empty rhetoric, but literally moonshine.
Earlier on, Minister of Foreign Affairs of the PRC Wang Yi said in a forum held by China-U.S. Think Tanks that the Sino-U.S. relations should “activate and open conduits for dialogues” and “get back to the right track”. On July 21, being asked about the Sino-U.S. relations on CCTV, Cui Tiankai, the Ambassador of the PRC in the U.S., remarked: “It is necessary to activate and open conduits for dialogues. Now that there isn’t even a conversation, it should be deemed abnormal”. It has suggested that China craves reopening a dialogue with the U.S.. However, Trump openly said he did not want to talk to Xi Jinping. The U.S. has already turned a deaf ear to China.
The Hong Kong version of National Security Law certainly plays a major role in contributing to the current predicament. The law has shown to the international community China would not live up to any promise. When the basic trust is gone, the basis for a dialogue is gone. Action is way more down-to-earth than rhetoric!
